Welcome to RAVEBAES (the "App" or "Website"), operated by RAVEBAES ("Company," "we," "us," or "our"). By creating an account, logging in, or using our services, you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the App.
1. Eligibility and Account Security
- Age Requirement: You must be at least 18 years of age to create an account and use this App. By using the App, you warrant that you have the right, authority, and capacity to enter into this agreement.
- Account Access: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2. Community Guidelines and the PLUR Code
RAVEBAES is built on the foundation of PLUR (Peace, Love, Unity, Respect). By using the platform, you strictly agree to maintain these values in all interactions, both online and offline.
- Prohibited Conduct: You explicitly agree not to engage in harassment, bullying, stalking, intimidation, discrimination, hate speech, or any form of toxic or abusive behavior.
- Consent: Mutual consent is non-negotiable. Unsolicited explicit messages, images, or aggressive behavior will not be tolerated.
- Prohibited Content: You may not upload or transmit any content that is illegal, explicit/pornographic, violent, or infringes upon the intellectual property rights of others.
3. Account Termination (The "Bouncer Clause")
We reserve the right, in our sole discretion, to investigate and take appropriate legal or operational action against anyone who violates these Terms.
- Absolute Discretion: Company reserves the unchallengeable right to suspend, disable, or permanently terminate your account and delete your data from our servers (including Firestore databases) at any time, for any reason or no reason, without prior notice or liability to you.
- No Refunds: If your account is terminated due to a breach of these Terms, you forfeit any remaining balance on premium tiers, subscriptions, or digital features without entitlement to a refund.
4. User-Generated Content and Rights
- Ownership: You retain ownership of the photos, text profile information, and data you upload to the App.
- License Grant: By posting content on RAVEBAES, you grant Company a worldwide, transferable, sub-licensable, royalty-free license to host, store, use, copy, display, and distribute your content solely for the purpose of operating, developing, and improving the App.
- Copyright Infringement: If you believe your copyrighted work has been uploaded to the platform without permission, please contact us immediately with proper digital ownership documentation.
5. Limitation of Liability (The "Dance at Your Own Risk" Clause)
PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
- No Background Checks: RAVEBAES operates strictly as an online matching utility to bring festival-goers together. Company does not conduct criminal background checks, identity verifications, or screenings of its users.
- Assumption of Risk: You assume 100% of all risks associated with using the App, including but not limited to any online communication or real-world, in-person interactions, meetups, or shared travel at music festivals, concert venues, campgrounds, or any other location.
- Disclaimer of Damages: In no event shall Company, its founders, affiliates, or partners be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the App, including without limitation, bodily injury, emotional distress, property damage, or any other damages resulting from communications or meetings with other registered users.
6. Dispute Resolution and Mandatory Arbitration
- Arbitration Agreement: You and Company agree that any legal dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, will be settled exclusively by binding, individual arbitration, rather than in a court of law.
- Class Action Waiver: You agree that any arbitration or legal proceeding will be conducted solely on an individual basis and not as a class, consolidated, or representative action. You explicitly waive your right to participate as a plaintiff or class member in any class-action lawsuit against Company.
7. Modifications to the App and Terms
Company reserves the right to modify, suspend, or discontinue the App or any of its features (including pricing models, subscription limits, and server operations) at any time with or without notice. We may also amend these Terms from time to time, and your continued use of the App after updates are posted constitutes explicit acceptance of the revised Terms.
